Terms of Service

These terms govern your use of Next Pair (the "Service"), available at nextpair.ai. The Service is operated by Piotr Klosinski Web and Mobile Development (NIP: 5641685247, Os. Stalowe 2/38, 31-920 Krakow), a sole proprietorship registered in Poland ("we", "us"). By using the Service you agree to these terms.
1. The Service
Next Pair is a conversational running-shoe advisor. You describe what you're looking for; we return opinionated recommendations grounded in expert reviews. The Service is brand-agnostic and editorially independent — see our affiliate disclosure.
2. Recommendations are informational
Recommendations from the Service are informational opinions, not professional, medical, or podiatric advice. Running shoes interact with biomechanics, injury history, surface, and individual gait. Consult a qualified professional (e.g. a sports physician or physiotherapist) for advice specific to an injury, medical condition, or rehabilitation programme. We do not warrant that any recommended shoe will prevent injury or improve performance for you specifically.
3. Accounts
You may use the Service without an account. If you create an account, you are responsible for keeping your sign-in credentials secure and for activity under your account. We may suspend or terminate accounts used to abuse the Service, scrape data, or violate these terms.
4. Acceptable use
You agree not to:
- Use the Service in violation of any applicable law.
- Scrape, mass-download, or systematically extract content beyond reasonable personal use.
- Attempt to interfere with the Service, other users' access, or the underlying infrastructure (denial of service, prompt injection used to extract proprietary content, exploitation of vulnerabilities, etc.).
- Misrepresent yourself or impersonate others.
5. Content and intellectual property
The Service, including the user interface, code, structured shoe data, and editorial frameworks, is owned by Piotr Klosinski Web and Mobile Development and protected by intellectual property law. Reviewer attributions cite third-party expert content (YouTube channels, blogs); copyright in those underlying reviews remains with their respective creators.
Conversation content you submit remains yours. You grant us a non-exclusive licence to process it for the purpose of providing and improving the Service, as described in our privacy policy.
6. Affiliate links
Outbound links to retailers may be affiliate links. We may earn a commission when you purchase through them. This never affects which shoes we recommend. Full details: affiliate disclosure.
6a. Connected services (Strava)
You may optionally connect a Strava account to the Service from the Settings page. The integration is read-only — we never write to your Strava — and is used only to ground recommendations and per-shoe stats in your own training data, as described in our privacy policy.
By connecting Strava, you acknowledge and agree that:
- Your use of Strava through the Service is also governed by Strava's API Agreement and Terms of Service, in addition to these terms.
- The Service is operated independently of Strava. Strava is not a sponsor or endorser of Next Pair, and we do not act on Strava's behalf.
- You can disconnect Strava at any time from the Settings page. Disconnecting immediately revokes our access and purges all Strava-derived data we have stored.
7. Availability and changes
We provide the Service on an "as available" basis. We may update, change, or discontinue features without notice. We will give reasonable notice before any change that materially reduces functionality for paid features (currently none).
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, accuracy of recommendations, or uninterrupted availability.
9. Limitation of liability
To the fullest extent permitted by applicable law, our aggregate liability arising out of or relating to the Service is limited to EUR 100. We are not liable for indirect, incidental, consequential, or punitive damages, including injuries or financial loss attributed to footwear choice.
Nothing in these terms limits liability that cannot be limited under applicable law (including, where applicable, statutory consumer rights under EU and Polish law).
10. EU consumer rights
If you are a consumer resident in the European Union, you have rights under EU consumer protection law that override any conflicting provision of these terms. Nothing in these terms is intended to limit those rights.
11. Governing law and venue
These terms are governed by the laws of Poland. Disputes will be brought before the courts competent for the registered address of Piotr Klosinski Web and Mobile Development, except where mandatory consumer-protection rules direct otherwise.
12. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the Service after a material change constitutes acceptance.
